Frankly this leaves girls in a very poor light.. its sheer idiocity on their behalf.
For me its consentual sex and not rape.
It should be decided on case to case basis.
If the dude was only flirting around - the intent was to have sex through emotional black male & marriage promises were only part of this big deceit then it should be considered as a rape.
Given the role that "promise to marry" played in "agreement to having sex" i.e. If girl wouldn't have had sex in absence of such promise and only agreed for sex due to such promise were made to her, in such case it should be treated as rape.
If the intentions were to marry initially but events led to a change of mind then it is a separate case

I read the case, the guy did deceit the poor lady. He shuould be punished but not under rape.

this is FRAUD... not RAPE. i hope people know the difference.
there should definitely be punishment for a guy who commits this FRAUD with a girl and it should be determined on a CASE to CASE basis according to the EFFECTS on the victim. just dont call it rape.
now let me prove how irrational this law is.
(1) since there is a lot of feminist bullshit around these days claiming that men and women can both be raped by each other...tell me what happens when a woman makes a false marriage promise with a guy? is the guy raped as well if they screw during the dourse of the relationship?
(2) virginity can be a very important and sacred thing for many girls BUT not an issue for others. what if the 'victim' of false promise is a girl who is otherwise quite open to casual sex and affairs and had sex in previous relationships. should the law apply to her as well? and if you say that it shouldnt and it should only be applied on victims who are genuinely effected then my naive friends, in law, rape is rape not bcos of the effect on the victim but because its rape in the TECHNICAL SENSE. i hope mr babarazm can understand this.
(3) there are a lot of guys out there (much greater in number than FALSE PROMISERS) who are STUDS & PLAYERS. they seduce girls and have sex with them without making any formal verbal commitment or a promise to marry. all the time the girl usually ASSUMES that the relationship is serious but he is only palying with her and in it for physical intimacy. what about these guys. just bcos they dont make a damn verbal promise would mean they get away with everything??
(4) there are many non-verbal cues and several other things which can IMPLY that the relationship has become serious. irrespective of a verbal promise.
(5) why do people think that its a 'marriage promise' that will attract women and make them jump into bed with any tom dick and harry and therefore a dangerous thing. you have to ATTRACT a girl first. the promise of marriage is only a much later stage in the relationship and if sex happens it means the girl is already sexually attracted to the guy. and also these days well before a prmise of marriage is made the couple usually engages in kissing and making out during the early stages.
so basically this is a very subjective thing. obviously cannot be classified as rape at all. it is an insult on the real victims of rape. if you wanna give punishment make a different law but dont confuse it under rape. this law only helps to protray women as weak and stuipid.
(6) what if a guy is serious with a girl and makes a promise of marriage and is having sex. BUT he misinforms her of somthing. something which is serious enough that will make it impossible for the marriage to realize. for instance the guy lies about his financial position, his caste/religion (which matters in society, or anything else that is serious enuff to cause a change in decisision. what will happen in such a case? the guy still says he is serious and not withdrawing his PROMISE.
will this be rape as well.
(7) according to this law if a married man is having sex with another woman without dosclosing his marital status to her then regardless of a marriage promise, it will be rape.
a rational human being knows that such a man is only liable to his wife for his extr-marital affairs.
Sex happens when a woman opens her legs unless they are forced open, therefore, ultimately it is always a woman's choice, regardless of the reasons why she chose to do so. I don't believe you can legislate morality or you risk creating a theocracy. There are other ways to liberate and empower women instead of such ridiculous legislation

why are we arguing on this issue? Pre-marital sex is a big NO NO in Islam. Does it matter if the guy has sex with his fiancé for god's sake? what are we exactly talking about "try before you buy it". A woman and man should not have sex before marriage at any cost. Then it shouldn't matter whether they're getting married or not.

Saira, its a discussion without involving religion. The cited report is about an Indian couple (who might be Hindus). Indian Law is secular at most.
I don't think this law would be neccessary in Pakistan as Pakistan is a muslim majority country and people with illegal sexual relations can not get married according to islam. Nikah is not allowed between a man and woman who have sexual relations so the women should not have sex with guys even if they are sure that he will marry them . Thats the indian problem and they are making laws for that so need to wake Pakistan up on that .BABARZM .
Is there any possibly way in which a girl can prove it to court that the guy asked me to marry him no girl can ever prove to the court and No.2 The court can not punish some one on the words of mouth of someone and the court has to give the benefit of doubt to the accused .

I have heard in some program in tv. Sex without marriage is not allowed in islam. If u have done sex with some one. Than it is better to get married with the same one. But it is necessary that both man and woman should realize than they had comitted a sin before marriage. They should do toba and then they should get married.

Totally disagree it is better not to have sex before marriage and if you had sex before marriage illegal relations can never become legal. I heard another programme on TV alim online where this issue was discussed and mullas in that programme did't allow marriage between a man and a woman who had sexual realations.

Why make any false promise about marriage and just have a normal affair and have sex? Or travel outside the country and go to the UK where they have many london escorts who will have sex with you.

I can't understand that y women open their legs for sex when they are told that they will be married soon after the sex.
Let me explain thru an example. if some man promissed with a woman that he will marry him and later on he changes his mind, than woman has no right to take any legal action against him. Secondy if during this period both man and woman enjoyed sex than it is due to will of both sides and both sides took benefit of it equally. When a woman has taken full hapiness and enjoyment during the sex than it is totally wrong that after some time he would force the man to get married to her.
